Agreement to terms
By accessing or using joindeparty.com and the Departy web application (the "Service"), you agree to be bound by these terms. If you don't agree, don't use the Service. The Service is operated by Bossy Music Pty Ltd trading as Departy ("Departy", "we", "us").
What Departy is (and isn't)
Departy is a personal planning tool. It helps you record your funeral wishes, important documents, medical preferences, legacy plans and related information.
Departy is not a law firm. We are not lawyers, financial advisers or medical professionals. Departy does not provide legal, financial, medical or tax advice. The planning tool is for personal organisation purposes — it helps you get your thoughts and preferences in order so the people around you don't have to guess.
Departy is not a substitute for a will, power of attorney, advance care directive or any other legal document. The information you enter into Departy has no legal standing unless separately formalised with a qualified professional. We strongly recommend you work with a lawyer for your legal documents, a financial adviser for your financial plans and a medical professional for advance care directives.
Eligibility
You must be at least 18 years old to use Departy. By creating an account, you confirm you meet this requirement.
Your account
You're responsible for keeping your login credentials secure. You're responsible for all activity that happens under your account. If you think your account has been compromised, contact us immediately at hello@joindeparty.com.
We reserve the right to suspend or terminate accounts that violate these terms.
Your content
You own everything you enter into Departy. Your funeral wishes, your documents, your plans — all yours. We don't claim any ownership over your content.
By using the Service, you grant us a limited licence to store, process and transmit your content solely for the purpose of providing the Service to you — including generating and delivering your PDF. We won't use your individual content for any other purpose without your explicit consent.
You're responsible for the accuracy of the information you enter. We store what you give us — we don't verify it.
The Departy Starter Kit
The Departy Starter Kit is a one-time purchase. Once you've bought it, you retain access to your Starter Kit and can log in to view and update your planning information for as long as Departy is operating. There is no recurring fee for the Starter Kit.
Future products and features
Departy may introduce additional products, features or subscription tiers in the future (such as Departy Keeper). These will be offered separately and are not included in the Starter Kit purchase unless explicitly stated. Buying the Starter Kit does not entitle you to access future products or features at no additional cost.
Departy reserves the right to set and modify pricing for new products or tiers. Existing Starter Kit access is not affected by future pricing changes — if you've bought it, it's yours.
Payments and refunds
Prices are listed in Australian dollars (AUD) and include GST where applicable.
Payments are processed by our third-party payment provider. We don't store your credit card or bank details.
Due to the nature of digital products, all sales are final. If you believe there's been an error or you're unhappy with your purchase, email hello@joindeparty.com and we'll do our best to resolve it.
Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access another user's account or data
- Reverse-engineer, copy or redistribute any part of the Service
- Use automated systems (bots, scrapers) to access the Service
- Upload content that is harmful, abusive or violates the rights of others
Availability and uptime
We aim to keep Departy available and running smoothly, but we can't guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates or circumstances outside our control. We're not liable for any loss caused by downtime.
Intellectual property
The Departy name, logo, website design, templates, guides, copy and all other original materials are owned by us and protected by copyright. You can't reproduce, distribute or create derivative works from our materials without written permission.
Limitation of liability
Departy is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We're not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits or reliance on information provided through the Service.
Our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including Australian Consumer Law.
Indemnification
You agree to indemnify and hold Departy harmless from any claims, damages, losses or expenses (including legal fees) arising from your use of the Service, your content, or your breach of these terms.
Account deletion
You can request deletion of your account and all associated data at any time by emailing hello@joindeparty.com. Before requesting deletion, you can download a PDF of your plan to keep a copy. We'll process deletion requests within 30 days. Once deleted, your data cannot be recovered.
Changes to these terms
We may update these terms from time to time. If we make significant changes, we'll notify you by email or by posting a notice on the website. Your continued use of the Service after changes take effect means you accept the updated terms.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, except where prohibited by law.
